Agreement to Terms of Use

Welcome to our website! Please read these terms and conditions (“Terms of Use”) carefully, as they constitute a legal agreement between you and Deeringer Wealth Management, LLC (“We”, the “Company”) to which you agree as a condition for use of our website (the “Site”). Use of the Site is limited to individuals who have the capacity to enter into legally binding agreements, and to those 18 years and older. By using the Site, you agree to be bound by these Terms of Use. If you disagree with any provisions in these Terms of Use, discontinue use of the Site immediately.

Jurisdiction Limitations

Deeringer Wealth Management, LLC is a registered investment adviser, and is in the business of providing investment-related advice. We must be registered, or exempt from registration, in each jurisdiction in which we conduct business. All communications between the Company and users of the Site who reside outside jurisdictions in which the Company is currently registered or exempt shall be limited so as not to trigger registration requirements in such jurisdictions. Nothing on the Site shall constitute personalized investment advice, which can only be rendered by the Company’s representatives after execution of a written investment advisory or financial planning or consulting agreement.

Limitations on Use

The Site is for your individual personal use, and authorized use is conditioned on your continued compliance with these Terms of Use. You agree to the following:

· You may not use the Site or any of its contents for any non-personal or commercial purpose;

· You may not copy, transfer, distribute, display, modify or create derivative works from the Site, any portion of the Site, or its contents;

· If you are given a password to access a portion of the Site, you may not allow others to use your user name or password. If your password has been compromised for any reason, you must notify the Company immediately. If you give your password to a third party, you are solely responsible for any actions that party takes using your password;

· You may not link other websites to the Site without the Company’s prior written permission;

· You may not take any action that imposes, or that we believe at our sole discretion imposes, an unreasonable load on our infrastructure or interference with our Site or its functionality; and

· You may not take any action that attempts to bypass any measures we may use to prevent or restrict access to the Site or its contents.

Ownership of Content

The Site and all its content are the property of the Company and are protected by U.S. and international copyright laws, with all rights reserved.  

No Securities Offering or Advice

The information on the Site should not be construed as investment advice, an endorsement or recommendation of any particular investment or security, or any form of securities offering. Nothing on the Site should be construed as personalized advice, which can only be communicated by the Company’s representatives after execution of a written investment advisory or financial planning or consulting agreement. The Company does not offer legal or accounting advice, and nothing on the Site should be construed as legal or accounting advice. We encourage users to consult their own professionals for such advice. 

Disclaimers and Limitation of Liability

The Site is for informational purposes only. Nothing on the Site constitutes personalized advice or any form of investment recommendation or securities offering. The Company shall not be liable for any claims or losses arising directly or indirectly from use of information on the Site, including any investment or trading actions taken by you or a third party based on information on the Site.

The Company does not make any warranties or representations, express or implied, about the information provided on or accessed through the Site.  All such information is presented “as is". In particular, the Company does not warrant or represent that the information is accurate, up-to-date, comprehensive, verified or complete.  The Company does not accept liability for any error, omission or delay in the information on the Site, or for any reliance placed by any person on the information.

Use of the Site is at your own risk. You are solely responsible for any computer damage, loss of data, malware or virus transfer, or any other loss or damage associated with use of the Site, links, or download of any of its content.

On occasion, the Site may be unavailable due to maintenance, technical issues, communications service outages, or other issues. The Company does not guarantee access to the Site, and does not accept liability for any claims or losses that may be associated with lack of access to the Site.

Investing involves a variety of risks, one of which is the potential to lose money, including loss of principal. When evaluating investments, past performance is no guarantee of future results.

If you are dissatisfied with the Site or any of its content, or any provision of these Terms of Use, your sole and exclusive remedy is to discontinue use of the Site.

Privacy

Use of the Site and communications between you and the Company are governed by our Privacy Policy.  lease read this Privacy Policy carefully before using the Site. We may update this Privacy Policy without notice, and by using the Site you agree to the terms of our Privacy Policy in effect at your time of use. We may ask for personal information such as name, address, email address, telephone number, and company.  We also collect information about aggregate site usage.  Statistics that we gather about unique visits, referring URLs, repeat visits and page views are all based on IP addresses, and are not associated with your personal information.  This information shall be considered confidential information and will be handled in accordance with our Privacy Policy.

The Site may use cookies to help track usage patterns on our site.  A cookie is a piece of data stored on the user's hard drive containing information about the user.  The cookie is only on the user’s computer and is not stored or retained in any form by the Site.  Usage of a cookie is in no way linked to any personally identifiable information while on the Site, and is used for the sole purpose of identifying a regular user’s preferences, so as to customize the user’s experience.  

Links to Third-Party Websites

The Site may provide links to third-party websites for your convenience, and accessing these websites through links directs you away from our website.  The Company is not responsible for errors or omissions in the material on third-party websites, and does not necessarily approve of or endorse the information provided.  Users who gain access to third party websites may be subject to the copyright and other restrictions on use imposed by those providers, and you assume sole responsibility and risks associated with use of third-party websites.

References

We may make reference on the Site to third-party materials, individuals, companies, or other entities. Such references do not imply or warrant that any of these entities are affiliated with, or that they endorse, the Company or its representatives in any way. Similarly, such references do not imply or warrant that the Company or its representatives are affiliated with or endorse such entities in any way. Nothing on the Site should be construed as a testimonial.

No Unlawful or Prohibited Use

You may not use the Site or any of its contents for any unlawful or prohibited use as governed by applicable law and regulation, or by these Terms of Use.

Modification

We may periodically modify these Terms of Service without notice. Please be sure to read the Terms of Service by accessing the link at the bottom of each page on the Site prior to your use of the Site. By your continued use of the Site, you agree to be bound by the Terms of Use in effect at the time of your use.

Termination

We reserve the right to terminate the Site, or to terminate or limit your access to the Site, without notice.

Governing Law

These Terms of Use are governed by the laws of the State of California. Jurisdiction and venue for settlement of disputes related to this Site or its related services shall be Sacramento County, the Company’s principal place of business.

Severability

If any part of these Terms of Use is deemed to be invalid or unenforceable under applicable law or regulation, the remainder of the Terms of Use shall continue in effect. 

Reservation of Rights

Any failure by the Company to enforce its rights in a timely manner does not constitute a waiver of the Company’s rights, rather all rights are expressly reserved.

Entire Agreement

These Terms of Use and the accompanying Privacy Policy and website disclosures represent the entire agreement between you and the Company governing use of the Site, and shall supercede all prior versions.
